ملخص البحث:

   هدفت هذه الدراسة لبيان توثيق العقد الإلكتروني ، والذي يشمل تعريف التوقيع الإلكتروني وصوره ، مع بيان أن التوقيع الإلكتروني أعم وأشمل من التوقيع الرقمي حيث أن التوقيع الرقمي جزءً لا يتجزأ من التوقيع الإلكتروني ، ووضح البحث أن للتوقيع الإلكتروني صوراً منها :

التوقيع بالقلم الإلكتروني ، التوقيع الرقمي ، التوقيع الرومتري ، والتوقيع باستخدام بطاقات الائتمان المقترنة بالرقم السري ، كما تناولت الدراسة صحة التوقيع الإلكتروني ، وبيان مفهوم السجل والمستند الإلكتروني وحجيتهما ، وبيان مفهوم المحرر الإلكتروني  ، وأخيراً اشتملت الدراسة على أهم النتائج وأبرز التوصيات ، فمن النتائج على سبيل المثال لا الحصر :

1/  التوقيع الرقمي هو الذي يتم انشاؤه أو إرساله أ استقباله أو تخزينه بوسيلة إلكترونية ويتخذ شكل حروف أو أرقام أو رموز أو إشارات يكون لها طابع منفرد.

2/ المستندات هي أداة جمع البيانات والمعلومات في عملية المراقبة وهي تُعتبر ذاكرة القسم المتخصِّص في المكافحة وحلقة الربط بين القسم والرئاسة والأقسام الأخرى.

ومن التوصيات على سبيل المثال:

1/ القيام بدورات تدريبية وورش عمل لمستخدمي بطاقات الائتمان وغيرها من المعاملات الإلكترونية ، وذلك اتقاناً للعمل وحفاظاً على الوقت والجهد.

Abstract

This study aimed to explain the electronic contract documentation, which includes the definition of electronic signature and its forms, with the expression that the electronic signature is broader and more comprehensive than the digital signature, as the digital signature is an integral part of the electronic signature. The research explained that electronic signature has many types such as pen-mail signature, digital signature, Rometric signature, and signature by using credit cards associated with PIN number. The study expressed the validity of the electronic signature, the concept of electronic record and document and their proof, and the concept of electronic edited document. Finally, the study concluded with the most important findings and key recommendations. Among the results:

1- Digital signature is the signature that is being created, sent, received or stored by electronic means and takes the form of letters, numbers, symbols or signs that have a unique character.

2- Documents are the tools of collecting data and information in the control process and are considered as the memory of specialist section in combating and the link between the section, the headquarter and other sections.

Among the recommendations:

1- Training courses and workshops for users of credit cards and other electronic transactions should be made for proper work and to preserve the time and effort.
