تناولت في هذا المبحث تعريف القرينة وحجيتها في الفقه لإسلامي،كما توصل الباحث في نهاية بحثه إلى :

أهم النتائج والتوصيات وعلى سبيل المثال لا الحصر من النتائج : الإثبات بالقرائن يحمل مزايا وخاصية الموضوعية إذ يمكن في تحديد شخصية الجاني بكل دقة وخاصة القرائن العلمية .

ومن التوصيات : عدم استخدام القرائن إذا كانت تمس بحرية وإرادة المتهم أو تؤثر على صحته البدنية أو النفسية أو العقلية عن طريق التنويم المغنطيسي أو جهاز كشف الكذب أو غسيل المخ ... إلخ

 Abstract

   This study deals with the definition of context and its proof in     Islamic jurisprudence. At the cud of the research, the researcher has come to several findings and recommendations. Among the findings that evidence by clues has the characteristic of objectivity, for it identifies the criminal character accurately , specifically the scientific clues.

   The study suggests not to use the modern scientific means if they touch and effect on the accused freedom and will, or effect on his bodily, psychological and mental health through the magnetic sleeping , falsehood revealing device or brain washing.
